Federal Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody

A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks lawful basis.

"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.

The case originates in a mistaken deportation to El Salvador in March, which the government later admitted was an mistake. After his return to the United States to answer human smuggling charges, he was detained in federal custody.

In her decision, the court pointed out that the government lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

The legal challenge center on conflicting assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.

He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in the state of Tennessee.

The court, who was overseeing his challenge to removal in a federal court, determined that he must now comply with the conditions of his bond from jail in Tennessee. This order shifts his monitoring to the Tennessee court.
